The Meristream service is optimized for use on desktop platforms. Due to performance constraints and optimization requirements, functionality is restricted on mobile devices, and full service capabilities are not supported. Users are encouraged to access the service through a desktop computer to ensure they experience its full functionality and performance. Meristream is not responsible for performance issues encountered on unsupported devices or platforms.
Meristream, unlike other platforms which claim to be generative, is truly generative in the sense that the music is being generated in your browser in real-time. Everything from the musical decisions to the actual sounds you hear are created from scratch (except for the piano). Because of this, Meristream can often be a computationally intensive program, so it is recommended that you run Meristream on a modern computer with sufficient RAM. Older devices sometimes succumb to poor performance due to this, although we have taken steps to reduce issues that arise from this extensively. Also, for increased performance, be sure to minimize heavy tasks on in your browser window while Meristream is playing.
By subscribing to our services, you agree to the terms of this Subscription Agreement, our Privacy Policy, and any other related documentation, as may be amended from time to time. If you are subscribing on behalf of an entity, you warrant that you have the authority to bind such entity to this Agreement. References to "Customer," "you," or "your" refer to the individual or legal entity subscribing to our service.
We offer various subscription packages detailed below. Your subscription will automatically renew for the same package duration unless you contact us to cancel the auto-renewal.
Personal Tier:
For individual users or small businesses, one device login.
Professional Tier A:
For businesses with 2-6 locations.
Professional Tier B:
For businesses with 7-19 locations.
Professional Tier C:
For businesses with 20-49 locations.
Professional Elite:
For businesses with 50+ locations. Contact for precise pricing.
Subject to this Agreement, Meristream grants you a non-exclusive, non-transferable right to use the service for personal or commercial use based on your subscription tier. The service is to be used only at the number of physical locations allotted in your billing plan. Any use beyond the specified number of locations is considered a violation of this Agreement. You agree not to modify, redistribute, reverse engineer, or reuse any code from the platform. Any such unauthorized use is strictly prohibited and constitutes a breach of this Agreement.
By subscribing to and using our service, you grant Meristream the right to collect your IP address for device recognition purposes. This helps us ensure adherence to the number of device logins allowed under your pricing tier, providing a secure and fair usage environment for all users. Meristream commits to not using this collected data for marketing purposes or sale to third parties.
Fees are billed in advance on a monthly or yearly basis and are non-refundable. Ensure accurate and complete billing information is provided to Meristream.
You must not misuse the service or assist anyone in doing so. Always comply with all applicable laws and regulations while using the service.
All rights, title, and interest in the service and its contents are the exclusive property of Meristream and its licensors.
Meristream may terminate your subscription for violation of these terms. Upon termination, your rights to use the service will cease immediately.
Meristream may modify these terms. We will provide at least 30 days' notice before any new terms take effect. Continued use of the service after revisions means acceptance of the new terms.
Meristream reserves the right to take legal action against any subscriber or user who violates the terms of this Agreement, including but not limited to unauthorized use of the service, infringement of intellectual property, or other actions that cause harm to Meristream or its users. Legal remedies may include seeking monetary damages, injunctive relief, and recovery of legal costs associated with enforcement.
These terms are governed by the laws of the jurisdiction where Meristream LLC is registered, without regard to conflict of law principles.
Refund Policy: Under certain conditions such as significant service downtime or failure to deliver the service, Meristream may offer refunds at its discretion.
Service Level Agreement: Meristream guarantees 99.5% uptime for its services. Should we fail to meet this level, subscribers may be eligible for credits against future billing.
Data Protection: We are committed to protecting your data. Our practices are detailed in the Privacy Policy, accessible on our website.
Renewal and Cancellation: Subscriptions automatically renew. You may cancel auto-renewal at any time through the Stipe portal, available from the account menu on the home screen.
Limitation of Liability: Meristream's liability for damages arising out of this Agreement shall be limited to the subscription fees paid by the customer.
Dispute Resolution: Any disputes under this Agreement will first be attempted to resolve via mediation. If unresolved, arbitration or litigation may be pursued.
Warranty Disclaimer: The service is provided "as is" without warranties of any kind, either express or implied.
Indemnification: Customers agree to indemnify Meristream against any claims arising from their use of the service.
Changes to Services: Any major changes to the service will be communicated at least 30 days in advance.
Electronic Communications: You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
By subscribing to our service, you acknowledge you have read, understood, and agreed to be bound by this Agreement.
Meristream reserves the right to modify subscription tiers and pricing. Subscribers will be notified with reasonable notice, and changes will be effective in the subsequent billing cycle.
